Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the BiteLytic application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and BiteLytic ("we", "us", or "our"). We reserve the right to update these Terms at any time.

2. Description of the Service

BiteLytic is an iOS application that uses artificial intelligence to analyze photographs of meals, assign a personalized nutrition score, and provide dietary advice. The App also includes features such as daily streaks, a friend leaderboard, barcode scanning, and an AI coaching assistant.

BiteLytic is intended for general wellness and informational purposes only. It is not a medical device and should not be used as a substitute for professional medical, dietary, or nutritional advice.

3. Subscription and Billing

BiteLytic offers premium features through auto-renewing subscriptions managed entirely by Apple's App Store:

• Free trial: New subscribers to the annual plan receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription begins automatically.
• Automatic renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Billing: Your iTunes/Apple ID account is charged at confirmation of purchase and at renewal. Prices are in EUR and may vary by region.
• Cancellation: You may cancel your subscription at any time through iPhone Settings → Apple ID → Subscriptions → BiteLytic → Cancel Subscription. Cancellation takes effect at the end of the current billing period; you retain access until then.
• Refunds: Refund requests are handled directly by Apple in accordance with their refund policy. We do not issue refunds directly. Visit support.apple.com/billing to request a refund.
• Price changes: We reserve the right to adjust subscription prices. You will be notified in advance of any price changes and given the option to cancel before they take effect.

4. Free Scan

Users who have not subscribed are entitled to one (1) free meal scan to try the service. This free scan is available once per account and does not reset. After using the free scan, a subscription is required to continue using the scanning feature.

5. Acceptable Use

You agree to use BiteLytic only for lawful, personal, non-commercial purposes. You must not:

• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use the App to transmit harmful, offensive, or illegal content.
• Circumvent any subscription verification or access controls.
• Use automated tools, bots, or scripts to interact with the App.
• Reproduce, redistribute, or resell any content, scores, or data generated by the App.
• Share your account credentials or subscription access with others.

6. Intellectual Property

All content within the App — including but not limited to the interface design, graphics, AI-generated scores and advice, the BiteLytic name, logo, and the underlying software — is the exclusive property of BiteLytic and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes in accordance with these Terms. No other rights are granted.

7. Disclaimer and Limitation of Liability

Not medical advice. The nutrition scores, dietary advice, and AI coaching provided by BiteLytic are for informational and motivational purposes only. They do not constitute medical, nutritional, or professional dietary advice. Always consult a qualified healthcare provider before making significant changes to your diet, especially if you have a medical condition.

AI limitations. Our AI may misidentify foods or produce imprecise scores. BiteLytic makes no warranty that meal analysis results are accurate, complete, or suitable for your specific health needs.

To the maximum extent permitted by applicable law, BiteLytic shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to health-related decisions made based on information provided by the App.

8. Privacy

Your use of BiteLytic is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully to understand our data practices.

9. Account Termination

We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by deleting it from your device. Deleting the app does not automatically cancel an active subscription; you must cancel through Apple's subscription management settings.

10. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

11. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with French law, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent French courts.
